1. GENERAL
1.1. These are the Terms of Use for AITI Online Services
(“Services”) which are owned and operated by the Authority for Info
communications Technology Industry of Brunei Darussalam (“AITI”). These Terms
of Use apply to both guests and registered users. The Services are delivered by
AITI through mobile application (“App”), AITI Online Services Portal (“Portal”)
and through downloading, installing or using any associated software supplied
by AITI.
1.2. Please read these Terms of Use carefully. By using the Services, you agree that you have read, understood, accepted and agreed to these Terms of Use. If you do not agree to these Terms of Use please do not continue using the Services.
1.3. The Terms of Use constitute a legal agreement between
you and AITI. By using the Services, you hereby expressly acknowledge and agree
to be bound by the Terms of Use.
2. END USERS AND REGISTERED END USERS
2.1. Using and accessing the Services by a person (“End
User”) does not require an account. Accounts can be registered by submitting
the personal data of a person (“Registered End User”).
2.2. The account is solely for use by the Registered End
User. The Registered End User is responsible to maintain the confidentiality
and security of the account details, but not limited to, including the
registered email address, username, One Time Password (OTP), PIN number, and
the passwords.
2.3. The Registered End User shall not use the account for
any unlawful or unauthorised use. AITI is not responsible for any loss incurred
or damage sustained arised.
2.4. The Registered End User may contact AITI Customer
Services or any official AITI feedback platform if there is any complaint or
concern relating to the Services.
3. USE OF THE SERVICES
The End User or Registered End User undertakes to use the
Services in a lawful manner and only for lawful purposes. AITI reserves the
right to seek all remedies or injunctive relief available under the law and in
equity as it deems necessary or appropriate in the event of a breach.
4. AVAILABILITY OF THE SERVICES
4.1. The Services is provided on an “as is” basis. AITI
provides no warranties of any kind and disclaims any warranty, whether express
or implied, as to the accuracy, correctness, reliability, currentness,
validity, timeliness, non infrignment, title or functionality for any
particular purpose of the Services.
4.2. AITI reserves the right to modify, alter, suspend or
discontinue the Services at any time, including with or without notice, and
shall not be liable to the End User or Registered End User.
4.3. While AITI makes every effort to ensure the Services
are available and functions as intended, the Services maybe be subject to
limitations, delays and other disruption inherent in the use of the Services.
4.4. AITI provides no warranty, assurance, or promise that
the Services will work as intended and AITI shall not be responsible for
temporary interruptions due to technical issues beyond its control.
5. ACCESSIBILITY TO THE SERVICES
5.1. Specifically, AITI will need the following permissions
in the App and Portal (where applicable) for the purposes set out below:
5.1.1. Access all User’s camera: To enable functions as
taking photos of supporting documents for applications and reading QR and
Barcodes to verify devices and documents.
5.1.2. Access Photos and Documents: To enable the uploading
of selected documents and photos identified as supporting documents for
applications as well as to save QR codes generated by the Service.
5.1.3. Access Location: To enable the App to read your
location (Longitude and Latitude) while using the Speedtest feature. Users will
not be able to use this feature if access is not provided. However, Users will
still have access to other features of the Services.
6. LINKS TO OTHER SITES
The Services may contain links to other Sites which are
provided solely as a convenience to our End Users or Registered End Users. End
Users or Registered End Users agree that accessing these Linked Sites are their
own responsibility. Such linked Sites are not under AITI’s control and AITI
will not be responsible for the content or any form of loss or damage that may
occur as a result of entering the Linked Sites.
7. PRIVACY
The use of the Services is also governed by our Privacy
Policy.
8. NOTICE
AITI may give notice by means of a general notice through
the Services, electronic mail to the End User or Registered End User’s email
address in AITI records or by written communication sent by registered mail or
pre paid post to the End User or Registered End User’s address in AITI records.
Such notice shall be deemed to have been given upon the expiration of fourty
eight (48) hours after mailing or posting (if sent by registered mail or pre
paid post) or one (1) hour after sending (if sent by electronic mail).
9. FEEDBACK
Any feedback the End User and Registered End User provides
shall be deemed to be non confidential. AITI shall be entitled to use such
information on an unrestricted basis.
10. INTELLECTUAL PROPERTY RIGHTS
All contents contained in the Services, including, but not
limited to, text, graphics, logo, icons, images, sound clips, video clips, data
compilations, page layout, underlying code and software is the property of
AITI. By continuing to use the Services, the End User or Registered End User
acknowledges that such content is protected by the laws of Brunei Darussalam.
11. LIMITATION OF LIABILITY
11.1. To the maximum extent permitted by law, AITI shall not
be liable for any direct or indirect loss, errors or omissions arising from the
use of the Services or any information contained therein.
11.2. The End User or Registered End User expressly agrees
that the use of, or inability to use, or activity in connection with the
Services is at their sole risk.
12. IDEMNITY
The End User or Registered End User agrees to indemnify AITI
and hold AITI harmless against any and all losses, liabilities, costs, claims
and expenses that AITI might suffer as a result of breach of these Terms of Use
or as a result of unauthorised or unlawful use of the Services.
13. MODIFICATION
13.1. AITI reserves the right to modify these Terms of Use
at any time without prior notice.
13.2. If any of the individual conditions in these Terms of
Use shall be limited, narrowed, construed or altered, void or invalid, the
remaining conditions will remain in full force and effect.
14. GOVERNING LAW
The Terms of Use is governed by and is to be construed
according to the laws of Brunei Darussalam and the End User and Registered End
User agree to submit to the exclusive jurisdiction of the Courts of Brunei
Darussalam.
