AITI derives its powers of licensing and regulation from the Telecommunications Order 2001. Section 5 allows AITI to grant licences for the operation of telecommunication systems and services subject to conditions imposed by AITI.
The establishment, installation, maintenance, provision or operation of unlicensed telecommunication systems or services within Brunei Darussalam is an offence for which the offender shall be liable on conviction to imprisonment for a maximum of 3 years, and/or a fine of up to B$100 000 with a continuing fine of up to B$10 000 per day for continuing offences after conviction. |

AITI's Licensing Framework is made up of an Operational Framework and Interconnection Handbook.
The Operational Framework describes AITI's licensing framework for the regulation of the telecommunications industry in Brunei Darussalam and sets out license categories, governing terms and conditions, application procedures and fee structure.
The Interconnection Handbook describes AITI's access and interconnection framework to facilitate interconnection agreements between players in Brunei Darussalam's telecommunication industry. It sets out the principles upon which AITI will facilitate access and interconnection agreements between players in Brunei Darussalam's telecommunications industry. It sets out the principles upon which AITI will facilitate access and interconnection agreements and also a dispute resolution process. The access and interconnection regime is an important component in AITI's regulation of the industry and facilitation of healthy competition between licensees.
The application procedures and other requirements are contained in AITI's Operational Framework document. For applicants seeking equipment type approval (e.g. for CPE) or importing equipment, the procedures illustrated in AITI's Operational Framework must be followed. Copies of the Operational Framework and the Interconnection Handbook can be downloaded at www.aiti.gov.bn or can be purchased from AITI. |

Infrastructure Provider for the Telecommunication Industry (InTi) Licence |
Service Provider for the Telecommunication Industry (SeTi) Licence |
| Description |
An InTi Licence is required by an operator to own and provide infrastructure, systems, networks, facilities and other equipment (except for customer premises equipment a.k.a "CPE") for the purposes of enabling telecommunication services to be provided. |
A SeTi Licence is required by an operator who sells services to consumers or corporate customers. A SeTi Licensee does not own its own infrastructure outside of its own premises, but uses the infrastructure provided by InTi Licensees.
However, a SeTi may provide CPE to its customers, or may own infrastructure within its premises to offer services to customers within its premises. |

Application fee is B$ 10,000 per licensable activity.
Plus an additional B$ 10,000 application fee if frequency spectrum is needed.
Periodic licence fee is 1.5% of the periodic gross turnover of the licensee subject to a minimum of B$ 100,000 per year payable every 6 months. |
